Statute of Limitations for Clergy Abuse and Sex Abuse Civil Cases:

ñ   There is a delayed tolling for people 21 years of age, they can file up to 3 years later. There is no explicit Statute of Limitations child sex act suits until they turn 24 years of age. Ark. Code Ann. § 16-56-116.

ñ   There is a 3 year Statute of Limitations for suits filed based upon sexual abuse of a minor from the time of discovery. The state of Arkansas is a “vested right” state, therefore it doesn’t allow the legislature to expand the Statute of Limitations to revive a barred cause of action. See Branch v. Carter, 933 S.W.2d 806 (Ark. 1996).

Statute of Limitations for  Sex Abuse and Clergy Abuse Criminal Cases:

ñ   The statute of limitations for sexual felonies is 6 years. Ark. Code Ann. § 5-1-109(b)(1)(A). Ark. Code Ann. § 5-14-124. The statute of limitations for sexual felonies besides rape is 3 years, and for sexual misdemeanors it is 1 year. § 5-1-109(b)(2)-(3).
